Article 3: Characteristics of the goods and services offered

The products and services offered are those listed in the catalog published on the Vendor’s website. Each product is accompanied by a description drawn up by the supplier. The photographs in the catalog are as accurate as possible, but cannot ensure perfect similarity with the product offered, particularly with regard to colors.

The Seller draws the Buyer’s attention to the washing and care instructions on the product labels. The Seller cannot be held responsible for any damage resulting from improper treatment of the products, or resulting from treatment that does not comply with these instructions.

These products and services are offered while stocks last. If, despite its best efforts, all or part of the items are unavailable, the Vendor will inform the Buyer by email as soon as possible and offer the Buyer the option of waiting or cancelling the order of the unavailable items free of charge. Available items will be delivered as normal.

Article 4 : Prices

The prices of the products and services displayed on the Infinitri site are indicated in euros (€) all taxes included (VAT and other applicable taxes). The Vendor reserves the right to modify its prices at any time. Nevertheless, the prices applicable to the order are those in force at the time of order confirmation.

The prices indicated do not include the costs of order processing, transport and delivery, insofar as these take place in the geographical zones specified below. The Buyer is invited to refer to the Shipping and Delivery section for further information on this subject.

The Vendor reserves the right to modify prices at any time, but products will be invoiced on the basis of the rates in force at the time the order is registered, and subject to stock availability.  The Vendor reserves the right to modify, limit or terminate a special offer or discount at any time.

Promotional codes are valid for a defined period and number of uses per customer. Under no circumstances may they be combined with other promotional offers or discounts on one or more items.

Article 5 : Orders

The Buyer must be at least 16 years old to purchase products on the Vendor’s website. He may only order from this store if he is a consumer, not a retailer. The Buyer guarantees that the information provided to the Seller at the time of the request is accurate and complete.

All orders are subject to approval. The Seller reserves the right, at its sole discretion, to refuse any order. The following are examples of reasons why an order may be refused:

The Vendor draws up and provides the Buyer with an invoice to confirm the purchase. This is also available in dematerialized form. The Vendor recommends that you keep this document, which may be requested in the event of a return or exchange.

Article 8 : Delivery

Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical area. Goods are transported at the Seller’s risk until they are delivered to the delivery address specified by the Buyer. From that moment onwards, the Buyer assumes sole risk. Delivery times are given as an indication only; if they exceed thirty days from the date of order, the sales contract may be cancelled and the Buyer reimbursed.

Delivery in Belgium and the European Union:

Items ordered on the website are subject to Belgian VAT (21%). The Buyer has no tax to pay on receipt of the parcel and cannot reclaim VAT.

The price is automatically calculated exclusive of tax on the invoice. Customs duties or other local taxes or import duties or state taxes may be payable. These duties and sums are not the responsibility of Art-in-Motion S.R.L. and shop Rainbows.cool. They are to be borne by the Buyer and are the Buyer’s sole responsibility, both in terms of declarations and payments to the competent authorities and organizations in the country where the goods are delivered. The Seller advises the Buyer to obtain information on these aspects from the local authorities.

SHIPPING AND DELIVERY

Shipping methods

Delivery takes place within 3 to 4 working days in Belgium from the time the order is processed, from Monday to Friday. The Buyer’s telephone number is required to ensure correct receipt of the parcel if the delivery address of a private individual or company is given.

The Vendor declines all responsibility for longer delivery times (particularly in the event of strike, loss or damage caused by the carrier), which are given for information only and must not be considered as firm deadlines. Exceeding these deadlines does not entitle the Buyer to any form of compensation.

Delivery terms and conditions can be consulted on the “Delivery zones and costs” site.

Rates

Shipping rates depend on the amount of the order and the shipping zone. Delivery options and rates will be clearly indicated when the order is confirmed, and will appear on the invoice.

Article 9: Personal data

All personal data required to process an order are kept by the Vendor or its employees and may be passed on to companies with which the Vendor – or its suppliers – collaborate(s), when such communication is necessary to process the order. The user also authorizes the Vendor to use this data to compile statistics in order to improve its site and the goods and services it offers. This information may also be used to disseminate, by any means of communication, information about the Vendor’s commercial activities to its customers.

Lastly, the Vendor retains personal data to facilitate subsequent orders. In addition, the Vendor undertakes not to divulge the information in its possession to any other company or business.

Article 10 : Warranty

With regard to consumers, the Vendor guarantees the products it sells and the services it provides in accordance with the law of September 1st 2004 relating to consumer protection in the event of the sale of consumer goods (articles 1649 bis to 1649 octies of the French Civil Code). In the event of non-conformity of a sold product observed within 2 months of delivery of the goods, the consumer must notify the Vendor as soon as possible in a precise manner by registered letter. This guarantee covers only defects in conformity existing at the time of delivery of the goods. Defects or damage due to improper use, such as water damage, oxidation, dropping or impact, negligence and wear and tear, are not covered by the warranty. Similarly, repairs carried out by technicians not approved by the supplier will invalidate the warranty. The invoice or delivery note serves as the warranty certificate and must be kept by the consumer and produced in the original.

If the product is used for non-private purposes, the supplier’s limited warranty conditions apply.

Any request to return a product due to a defect must first be validated by customer service by sending photos of the problem.

If the defect is confirmed, the product will be exchanged while stocks last. Failing this, the product will be refunded to the customer.

Any item returned without prior validation by customer service will be considered damaged by the customer and will not be reimbursed.

The Vendor cannot be held responsible for the misuse and/or intensive use of the articles by the customer.

Article 11: Availability of the website

The Vendor does not guarantee that the website, or any content contained therein, will always be accessible or uninterrupted. Access to the website is permitted on a temporary basis. The Vendor may suspend, delete, interrupt or modify all or part of the website without notice. The Seller shall not be held liable in the event of the website being unavailable, for any reason whatsoever, at any time and for any duration.

In view of the frequency of visits to the site, the very high demand for certain items, and the automatic stock updating system, it is possible, in exceptional cases, for the number of items sold at any one time to exceed the actual stock at that precise moment.

Orders placed between Friday lunchtime and Sunday evening are checked on the following Monday morning. Please note that an order confirmation only confirms receipt of the order. It is only when an e-mail containing a carrier tracking number is issued that the purchase is 100% confirmed and the goods have been dispatched.

Article 12: Liability

The Vendor, in the online sales process, is bound only by an obligation of means; it cannot be held liable for any damage resulting from the use of the Internet network, such as loss of data, intrusion, virus, breakdown in service, or other involuntary problems. All information on this site is given in good faith. Links to manufacturers’ and/or partners’ websites are provided for information purposes only. The Vendor cannot be held responsible for information from these sites.

Article 13 : Intellectual property

All elements of the Vendor’s site are and remain the exclusive intellectual property of the Vendor. No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site, whether software, visual or sound. Any simple link or hypertext link is strictly forbidden without the prior written consent of the Vendor.
